Foreign contractors will be allowed to work in capital construction for the first time
This news has been stated on May 22 by the Presidential Decree "On additional measures to optimize the design and construction procedure in capital construction."
In particular, the document defines:
- Licensing of expert review has been cancelled for construction projects. At the same time, the Accreditation Centre under the National Project Management Agency under the President (NAPU) is now to be responsible for accreditation of persons, who will conduct the expert review of construction projects;
- Licenses on development of architectural and urban planning documentation will be issued by NAPU, and on other types of construction activity - by the Ministry of Construction in consultation with NAPU;
- NAPU has the right to allow contractors (including foreign ones) to implement projects on a turn-key basis (Engineering Procurement Construction – EPC Contractors) by a fast-track method (simultaneous design, procurement and construction), without a requirement for them to obtain a corresponding license or permit. At the same time, these projects should be listed in the State Development Programs of the country, and the EPC contractors shall bear their full responsibility for quality of the project.
Besides, an EPC Contractor must have its practical experience in implementing projects using the fast-track method and meet certain financial performance indicators. It is also required for them to have a sufficient number of competent engineers and experts.
NAPU has the right to make a direct contract on public procurement between the state customer and EPC Contractor, who has been granted an admission to implement fast-track projects.
